This document sets forth the terms and conditions, privacy practices, and release of liability applicable to participation in the Bodyshift Fitness Youth Athletic Training Camp (the “Camp”), held at 412 N. Midland Dr Suite F. Because all participants are minors, this document must be reviewed and accepted by the participant’s parent or legal guardian during registration. By registering a child for the Camp, the parent or legal guardian acknowledges and agrees to the provisions below.
1. Terms and Conditions
1. Eligibility and Registration. The Camp is intended for youth participants of the ages designated by Bodyshift Fitness. Registration is not complete until all required information is provided and this document is accepted by the participant’s parent or legal guardian.
2. Camp Sessions, Schedule, and Location. The Camp will be conducted at 412 N. Midland Dr Suite F. Available camp sessions are: Camp 1: 6/8–6/12; Camp 2: 6/15–6/19; Camp 3: 6/22–6/26; and Camp 4: 6/29–7/3. Daily time slots for each session are 9:00 a.m.–10:00 a.m., 10:00 a.m.–11:00 a.m., 6:00 p.m.–7:00 p.m., and 7:00 p.m.–8:00 p.m. Bodyshift Fitness may assign or confirm participants to a specific session and time slot during registration.
3. Transportation, Drop-Off, and Pick-Up. Participants and their parents or legal guardians are solely responsible for arranging and providing transportation to and from the Camp. Bodyshift Fitness does not provide transportation services or supervision outside the participant’s scheduled session time. Participants should not be dropped off early and should be picked up promptly at the end of their scheduled time slot. The parent or legal guardian remains responsible for the participant before check-in and after pick-up.
4. Health and Fitness Disclosure. The parent or legal guardian represents that the participant is physically able to take part in athletic training activities and use exercise equipment under supervision. The parent or legal guardian agrees to disclose any medical conditions, injuries, allergies, physical limitations, medications, or other health concerns that may affect participation.
5. Camp Activities. Camp activities may include warm-ups, conditioning, strength and agility exercises, movement drills, instruction on proper body mechanics, and use of exercise equipment and related fitness tools. Activities may be modified at the sole discretion of Camp staff for safety, instructional, or operational reasons.
6. Rules and Conduct. Participants are expected to follow all instructions given by Camp staff, use equipment only as directed, treat others respectfully, and comply with all safety rules. Bodyshift Fitness reserves the right to remove a participant from any activity or from the Camp if the participant engages in unsafe, disruptive, or inappropriate conduct.
7. Supervision and Emergency Response. Camp staff will make reasonable efforts to supervise activities and promote safe participation. In the event of illness, injury, or emergency, the parent or legal guardian authorizes Bodyshift Fitness and its staff to obtain or arrange emergency medical care for the participant when the parent or legal guardian cannot be reached promptly. The parent or legal guardian understands that they are responsible for any resulting medical expenses.
8. Personal Property. Bodyshift Fitness is not responsible for lost, stolen, or damaged personal items brought to the Camp.
9. Schedule and Program Changes. Bodyshift Fitness may modify Camp schedules, instructors, activities, equipment, or locations as reasonably necessary.
10. Refunds and Cancellations. All sales for the Camp are final. Registration fees and any other amounts paid in connection with the Camp are non-refundable. No refunds, credits, transfers, or make-up sessions will be provided for cancellations, missed sessions, partial attendance, scheduling conflicts, illness, dismissal or removal from the Camp, or any other reason, except where required by applicable law.
11. Consent to Media Use. By registering the participant for the Camp, the parent or legal guardian gives permission to Bodyshift Fitness to photograph, film, record, or otherwise capture the participant’s image, likeness, voice, and performance during Camp activities, including while the participant is performing exercise or training activities. The parent or legal guardian authorizes Bodyshift Fitness to use, reproduce, publish, display, distribute, and edit such media for lawful business, educational, promotional, and marketing purposes in any format or medium, including print materials, websites, email communications, presentations, and social media, without compensation to the participant or parent or legal guardian.
12. Acceptance. Registration for the Camp constitutes acceptance of these Terms and Conditions by the parent or legal guardian on behalf of the participant.
2. Privacy Policy
1. Information Collected. Bodyshift Fitness may collect registration and participation information including the participant’s name, age, date of birth, emergency contact details, medical and allergy information provided by the parent or legal guardian, attendance records, and payment-related information necessary to administer the Camp.
2. Use of Information. Collected information may be used to process registrations, communicate with families, maintain attendance and emergency contact records, support participant safety, respond to medical or operational needs, improve Camp programming, and comply with applicable legal obligations.
3. Medical and Emergency Information. Health-related information provided by the parent or legal guardian will be used only for participant safety, emergency response, and Camp administration on a need-to-know basis.
4. Media and Promotional Content. Photographs, videos, and other recordings taken during Camp activities may be used as described in the Consent to Media Use provision above. Parents or legal guardians should not register a participant if they do not agree to such media use.
5. Information Sharing. Bodyshift Fitness does not sell participant personal information. Information may be shared with Camp staff, coaches, instructors, service providers assisting with Camp operations, emergency responders, medical providers, insurers, or legal authorities when reasonably necessary for Camp administration, safety, legal compliance, or protection of rights.
6. Data Retention. Bodyshift Fitness may retain registration, consent, incident, and payment records for as long as reasonably necessary for Camp operations, legal compliance, dispute resolution, safety review, and recordkeeping.
7. Security. Bodyshift Fitness will use reasonable administrative and operational measures to protect personal information, but no method of storage or transmission can be guaranteed to be completely secure.
8. Parent and Guardian Responsibility. The parent or legal guardian is responsible for providing accurate and current information and promptly notifying Bodyshift Fitness of any updates to contact, medical, or emergency information.
3. Release of Liability and Assumption of Risk
1. Assumption of Risk. The parent or legal guardian understands and acknowledges that participation in athletic training, conditioning, strength work, agility drills, and the use of exercise equipment involve inherent and unavoidable risks. Such risks may include, without limitation, slips, trips, falls, overexertion, strains, sprains, bruises, fractures, head injuries, equipment malfunction, improper use of equipment by participants, contact with other participants, and other serious bodily injury. The parent or legal guardian voluntarily chooses to allow the participant to engage in these activities with knowledge of such risks.
2. Release and Waiver. To the fullest extent permitted by applicable law, the parent or legal guardian, on behalf of the participant and themselves, releases and discharges Bodyshift Fitness and its owners, officers, directors, employees, contractors, trainers, coaches, agents, representatives, volunteers, affiliates, successors, and assigns from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to the participant’s attendance at or participation in the Camp, including the use of exercise equipment and participation in supervised training activities, except to the extent caused by gross negligence or willful misconduct where such limitation is not permitted by law.
3. Indemnification. To the fullest extent permitted by applicable law, the parent or legal guardian agrees to defend, indemnify, and hold harmless Bodyshift Fitness and the other released parties from claims arising out of the participant’s conduct, violation of Camp rules, or the inaccuracy of information provided during registration.
4. Medical Authorization. The parent or legal guardian consents to reasonable first aid and emergency medical treatment for the participant if needed during Camp activities and understands that Bodyshift Fitness does not assume responsibility for medical expenses incurred.
5. No Guarantee. The parent or legal guardian understands that Bodyshift Fitness does not guarantee any particular athletic, fitness, or training result.
6. Severability and Governing Law. If any portion of this document is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect. This document shall be governed by the laws of the state in which the Camp is conducted, without regard to conflict of law principles.
7. Acknowledgment. By registering the participant for the Camp, the parent or legal guardian confirms that they have read this document, understand it, and agree to it voluntarily on behalf of themselves and the participant.
